From the South Carolina AGs Office – South Carolina Attorney General Alan Wilson joined a coalition of 10 states in suing the Biden Administration over its latest student loan forgiveness scheme.

“Joe Biden does not have the ability to cancel debt. To keep an outlandish campaign promise, he abused power he didn’t have to implement an unlawful student debt cancellation program. We argued against it, and last year the U.S. Supreme Court agreed the program was unlawful,” said Attorney General Alan Wilson. “Facing a tough reelection, Biden is scrambling again. He knows he doesn’t have the power to cancel debt and thinks he can find a loophole around that. We’ll continue pushing against his unlawful federal overreach, no matter how long it takes.”

The multistate lawsuit argues the U.S. Department of Education doesn’t have the authority to alter student loan repayment plans, essentially cancelling more than $156 million in student loan debt. It also argues the U.S. Supreme Court struck down an earlier version of Biden’s unlawful student loan debt program last summer. The Court ruled the program violated federal law and that only Congress can authorize the forgiveness of student loans, which requires spending taxpayer money to do so. Attorney General Wilson was also part of the original case that went before the U.S. Supreme Court last year.

Attorney General Wilson joins Alabama, Alaska, Idaho, Iowa, Kansas, Louisiana, Montana, Nebraska, Texas, and Utah on the latest suit.
